Agreement
By using https://www.creatinggoodproblems.com (the “Site”), booking a consultation, or connecting related apps (such as QuickBooks via Intuit), you agree to these Terms of Use (“Terms”) with Creating Good Problems LLC (“CGP,” “we,” “us”).
For a web-based service, these Terms serve as our public end-user terms (EULA-style agreement). A separate downloadable-software EULA is not used. If a signed engagement letter or SOW conflicts with these Terms for a paid program, the signed document controls for that engagement.
Who we serve
CGP provides consulting, coaching, accountability, and related professional services for business and personal clients. The Site is for adults (18+) and business users. You represent that you have authority to book and pay for services for yourself or your organization.
Nature of the services
Consulting and coaching are professional advisory and accountability services. They are not licensed legal advice, tax advice, certified public accounting, investment advisory services, therapy, or medical care. You remain responsible for decisions you make and for obtaining advice from appropriately licensed professionals when needed.
Bookings and fees
- The public path is one paid initial consultation described on the Site (currently $50 · 1 hour · Google Meet, Eastern Time). Details on the booking page control if they differ.
- You complete structured intake (including personal vs business focus and preferred support type), then pick a live time. Booking holds the time via Wix Bookings.
- Payment is collected through a QuickBooks invoice / Payment Link (or another method we specify) — not as a card charge on this marketing page itself.
- If you continue into a consulting or coaching program, the consultation fee may be credited as described at the time of booking.
- Cancelation, rescheduling, and no-shows follow the policies shown in Wix Bookings or stated in confirmation emails. If no policy is shown, contact us promptly at info@creatinggoodproblems.com to reschedule; we may treat late cancelations or no-shows as forfeited for that fee.
No guaranteed outcomes
We do not guarantee revenue, funding, valuation, savings, employment, or other business or personal results. Testimonials or examples, if any, reflect individual experiences and are not promises of typical results.
Confidentiality
We treat information you share in intake and sessions as confidential client matter for delivering your engagement, subject to the limits in our Privacy Policy (including legal compulsion and safety). You agree not to misuse others’ confidential information you may access through the Site.
Connected services
The Site and practice use third-party platforms, including Wix (bookings/contacts), Vercel (hosting/API), Google Meet (video), email providers, and QuickBooks / Intuit for invoicing. Your use of those products is also governed by their terms. By authorizing a QuickBooks connection, you allow CGP systems to create and manage invoices and related customer records needed to bill for services you request.
Acceptable use
You agree not to:
- Misuse the Site, attempt unauthorized access, or disrupt our systems
- Submit unlawful, misleading, or infringing content in intake forms
- Use the Site to spam or harass
- Book in bad faith or provide payment details you are not authorized to use
We may refuse, suspend, or cancel a booking or Site access if we believe these Terms were violated or if we cannot appropriately serve the request.
Intellectual property
Site content, branding, and materials we provide remain CGP property unless we agree otherwise in writing. You may use deliverables we create for you under your engagement for your internal business purposes. You grant us a limited license to use feedback you volunteer about the Site to improve our services, without obligation to you.
Electronic communications
You consent to receive service-related communications electronically (email and notices on the Site), including booking confirmations and invoices. These satisfy any legal requirement that communications be in writing.
Disclaimer
THE SITE AND SERVICES ARE PROVIDED “AS IS” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CGP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE OR A BOOKING ON THE SITE IS LIMITED TO THE AMOUNTS YOU PAID TO CGP FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE CLAIM.
Indemnity
You will defend and indemnify CGP against claims arising from your misuse of the Site, your breach of these Terms, or your business decisions following our advice — except to the extent caused by our willful misconduct.
Privacy
Our Privacy Policy explains how we collect and use personal information and is incorporated by reference into these Terms.
Changes
We may update these Terms by posting a new version on this page. Continued use after changes means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules, unless mandatory consumer law in your jurisdiction says otherwise. Courts located in Florida (including Broward County where applicable) shall have exclusive jurisdiction, subject to those mandatory rights.
